General

  • Any artwork that I finish for a commission client may be posted on any website by that client so long as credit is directed to my account: shaidz.deviantart.com
  • Artwork that has been received by the client may be privately modified (e.g. recolored, resized, cropped, have added text) and used by that client exclusively unless public modification is part of the initial intent expressed by the client. Modifications that are inappropriate, offensive, or otherwise hurtful are not condoned.
  • Other acceptable uses of artwork received by clients include use as profile pictures.
  • Clients may not use artwork received for any purpose other than the above without my written permission.
  • No party may use my artwork for any reason, unless they are the original client with the privileges specified above.
  • I reserve the right to post all artwork I create to any website I choose, but will likely be willing to keep the artwork private if requested by the client.
  • If I consider any of the policies in this document or otherwise individually stated agreements to be broken, I will request that any artwork at any stage of the creation process be removed from all publicly available locations.

Appropriate Artwork

  • As a rule of thumb, I will usually reject requests for inappropriate, offensive, or otherwise hurtful material.
  • Moderate blood and minor violence may be accepted, but I will make personal judgement on what I consider excessive.
  • Mild intimacy such as light kissing or non-sensual embracing may accepted.
  • No nudity. Reasonable clothing or "stylization modesty" will be required on all characters.
  • Fetish related artwork will not intentionally be accepted. If you feel the need to ask if it falls into this category, it probably does.
  • I reserve the right to reject any request that violates any of the aforementioned policies or involves what I consider bizarre, inappropriate, or otherwise offensive imagery or behavior.

Payment

  • Paypal transactions only. DeviantArt "points" are undesirable and will likely be rejected as acceptable currency.
  • 1/2 upfront payment, and 1/2 payment after completion is preferred. Upfront complete payment is acceptable, but is not necessary.
  • No artwork will be started until at least the first 1/2 of payment is received.
  • If additional detail entailing a higher than previously established price is desired once artwork has already been started, payment for the addition will not be required upfront, but will be expected upon completion.

Completion

  • A deadline of 7 business days per character will be set after upfront payment, but work can usually be expected to be completed sooner.
  • If multiple clients have paid upfront, the earliest established clients will given priority, and other clients' deadlines will not be started until the prioritized client's is completed.
  • Exceptions to deadlines must be discussed on an individual basis, and may be considered if my current workload can support them.
  • Exceptions to priority must be discussed on an individual basis, but will unlikely be given.
  • If I happen to exceed this limit by negligence or otherwise, I will be willing give a full refund. However, I will cease to work on the discussed artwork.
  • If the client expresses that they are willing to wait an extended period for their artwork, I will do my best to complete the artwork in a timely fashion.
  • If any delays due to my employment or personal issues arise, I will provide notice, but will prioritize these before artwork progress.

Progress

  • All clients will be updated on the progress of their artwork on a regular basis. Exceptions to this may occur in the case of delays regarding my employment or personal issues.
  • Preliminary sketches and progress images will be available upon request, but will be watermarked to avoid early or agreement violating usage.
  • If the client desires periodic assessments of the artwork, I will do my best to provide them with status updates for stages of the artwork process, which can include previously mentioned sketches and progress images.

Changes

  • Should the client desire any changes to be made to the artwork during the initial sketching stage of the artwork process, there will be no extra charge beyond the initially discussed price unless entailing a major detail level change.
  • Should the client desire minor changes to be made at any further stage during the artwork process (e.g. small feature changes or slight positioning changes), there will be no extra charge beyond the initially discussed price.
  • Should the client desire major changes to be made at any stage during the artwork process after sketching (e.g. redesigning a character so that it is noticeably different than originally desired or completely changing the positioning of the character beyond minor shifting or rotation), either an additional charge will be required and discussed, or work on the artwork will cease without refund.

Cancellation

  • If, during the sketching stages of the artwork process, the client no longer desires the artwork or desires a refund without completion, work on the artwork will cease, and a full refund for any payment will be given.
  • If, during any stage of the artwork process following sketching, the client no longer desires the artwork, work on the artwork will cease, but no refund will be given if significant work on the artwork has already been completed.

Exceptions

  • Modifications and exceptions to all of the above policies may be discussed and agreed upon on a client-by-client basis.
  • Priority for specific clients will only be considered for deadline purposes, but will not be guaranteed to be accepted.

Legal

  • I will not take paid commissions or otherwise intentionally profit from copyrighted material. By making a request, commission, or other agreement with me regarding any content I produce, they are accepting full legal responsibility for any infringement that arises due to my unawareness of the copyright or otherwise private intellectual property.
  • I require that the client either owns all of the intellectual property of the contents of any resulting artwork, or has been given appropriate licensure or respective permission to all of the contents thereof. This includes, but is not limited to, characters, symbols, quotes, scenery, and other references to copyrighted or otherwise private intellectual property.
  • The existing art in my gallery that has referenced copyrighted material has been made with the intention of promoting the source content and adding commentary on my own appreciation for the source material, and is by no means intended to replace or otherwise take undue benefit from the owners of the referenced material. Drawings of this nature will not be accepted for commissions or otherwise paid work.
